Law 7/15, from June 15, has proceeded to a revision of the General Labor Law (Law 2/00, from February 11), changing the applicable regime to employment relationships in Angola.
This is major change to the Angolan employment regime, which is clearly in the interest of companies already established or those pursuing to invest in Angola but which are not willing to remain restrained by long term employment contracts.
Another important change that Law nº 7/15 brings is that it establishes distinctive regimes for large, medium, small and micro-sized companies.
The maximum duration of fixed term employment contracts has been amended making it now possible that contract are renewed up to a maximum of (5) five years or (10) years.
Law 7/15 eliminated the comprehensive list of justifications required for entering into set term labor contracts. This new law establishes that set term employment contracts may now be entered into by mutual agreement of the parties, considering the nature of the activity, the size and economic capacity of the company and the employee’s duties under the employment contract.
In addition to the provision of fixed term contracts mentioned above, remuneration for different work schemes and night shift and overtime regimes, which remain for large companies, have been cut for medium, small and micro-sized businesses.
The same methodology has been approved in regard of compensation and indemnity rules concerning payments to workers on termination of employment contracts. The new Law limited significantly the amounts due to the employees, which now vary, once again, according to the company’s size, established considering the provisions of the Micro, small and Medium Companies’ Law, enshrined in Law n. 30/11, of September 30th.
Yet another important amendment is that employers must approve internal regulations with the purpose of organizing work and labor discipline.
